Prosecutors are immune from criminal prosecution or civil law suit.
Jurors are the ultimate deciders of the law and the facts of a case. You are not obligated to follow the judges instruction regarding the law concerning a case. See FIJA
It has been said that “a Prosecutor can indict a ham sandwich”
Don’t be a rubber stamp, Know your rights as a Grand juror
American Law originated with English Common Law which was founded on Natural Law.
Despite the 1000’s of laws on the books they can all be broken down to two fundamental rules of Natural Law
Do not trespass against others
Honor what you say you’ll do
Everything else is political in nature, designed to benefit a select few at the expense of everyone else.
In the old days if you violated one of these laws you had to compensate your victim. If you refused you became outlawed (this is were the term outlaw came from) and therefore the law did not protect you.
The king realized that he could benefit from the plight of his subjects if all offenses became not only violations against the individual, but the king as well. That is how we came to this point where now the state/government takes the role of the king. All offenses have become violations against the state. What the people get in return is more taxes, more government and the high cost of revenge rather than compensation.
For example:
Someone steals your $1,000 TV and goes to jail for 10 years at a cost of 14,000 a year for a total cost of $140,000. You are never compensated for your lost. The community shares in the $140,000 cost of incarceration through taxes. No business could function this way and survive. They propose to help you by taking more money from you. As angry as you might be over your lost if you were directly taxed you would refuse pay 140 times more over your initial lost. Who really benefits from such a system, the people or the government?
Who benefits from such a system?
Only the king/government via increased power and profits (taxes)
We live in a Constitutional Republic. This means the rights of the individual is as important as the whole.
These individual rights are what keeps democracy ( mob rule) in check.
Benjamin Franklin described Democracy as two wolfs and a sheep deciding what is for diner.
“I know I would not want to be the sheep”
In a purely democratic society a two to one vote would be all that is necessary to deprive someone of their property or liberty, all that is needed is a majority.
In a Constitutional Republic the right’s of the individual are protected against the interest of the mob, in most cases this means the government.
These individuals rights are defined in the Constitution and safe guarded through Due Process. These rights are protected via the Grand Jury and Petite/trial jury systems. If the public is kept ignorant of these facts the government is able to deprive of us of our rights. Every day in America juries are presented with the opportunity to nullify bad law and to protect the rights of citizens. The jury system is the line in the sand against government abuse.
